Description

This is a condominium unit of 59.44 sq m in Rawai, Phuket, sold at an official court-ordered auction run by the Legal Execution Department of Thailand. It comes with a condominium unit title, and there is no mortgage on the unit.

The auction is public and takes place at the Department's office in Phuket. The Department publishes an official appraisal and a schedule of auction rounds. If a round passes without bidders, the next round starts at a lower price under the Department's rules. Every bidder places a security deposit on auction day. The final price is set at the auction and can be higher than the starting price if several bidders take part. The current round, its date, the starting price, the deposit and our turnkey estimate are shown in separate blocks on this page and updated daily from the official announcement.

The price structure works like this. The turnkey estimate is the starting price of the current round plus our support fee, which is a share of the hammer price, plus a fixed lawyer fee. The page calculates it, and a calculator shows the total for your own bidding limit. Government transfer fees are paid separately. If you do not win the auction, you pay only a lot check advance. After a win, that advance counts towards the lawyer fee.

We support foreign buyers through the whole process. Foreigners can own a condominium unit within the 49% foreign quota of the building, with funds transferred from abroad. Banks almost never lend for auction purchases, so plan to use your own funds. The purchase steps are shown on this page in the block "How it works".

Our support covers:

  • a lawyer's check of the title, encumbrances and condominium debts;
  • an inspection of the building from outside and, if possible, inside;
  • placing the security deposit and bidding up to your limit;
  • paying the balance within 15 days after a win (an extension of up to 3 months is possible on request) and registering the title at the Land Office;
  • handover and, if needed, eviction through the court officer.

Please be aware of the risks. The announcement lists the title holder as the occupant, so vacant possession is not guaranteed, and eviction goes through the enforcement procedure. Our lawyer explains the likely timing. An inside viewing is often impossible, and the condition at handover is not guaranteed.

This lot suits a buyer who is comfortable with the auction procedure, accepts these risks and has their own funds ready.

How it works

1Choose a lot

The catalogue shows only condominiums a foreigner can register in freehold within the building quota. Send a request with your price limit.

2We check

The lawyer reviews the title deed, encumbrances, unpaid common fees and who occupies the unit. We inspect the property from outside and, when possible, inside. The check costs an advance of 30,000 THB, credited to the legal fee if you buy.

3We prepare

A service agreement, a power of attorney for bidding, and a transfer of funds from abroad with the FET form needed later for registration.

4We place the deposit

On auction day the deposit is paid to the Department; the amount is shown on the lot page. If the bid is not won, the deposit is returned in full.

5We bid

Our representative takes part in the auction and raises the price only up to your limit. You do not need to attend.

6You buy

After winning, the balance is paid within 15 days, extendable to three months on request. Our fee of 10% is calculated from the hammer price. Title registration at the Land Department; government fees are paid separately.

7You get the keys

If the previous owner still lives in the unit, eviction goes through the enforcement officer under the law and the lawyer handles it to the end. Then we help with renovation, rental or resale.

Honest about the risks

  • In most lots the previous owner or a tenant still lives there on auction day. Handover goes through enforcement proceedings, which takes time; the lawyer runs the process.
  • An inside inspection is often impossible before the purchase. The condition at handover is not guaranteed, so we budget for renovation from the start.
  • Lots with a transferable mortgage are not included in the catalogue.
  • The price can rise at the auction. We never bid above your limit, and if the lot goes higher, we find the next one.
  • A foreigner buys a condo only within the 49% building quota and with funds transferred from abroad. We verify the quota before the deposit.
